Washington – Two vehicles fell into the Skagit River after a trucker bumped the framework of a bridge on Interstate 5 and it collapsed. As reported by the Associated Press (AP), no one was killed in connection with the incident, and the three people who fell into the icy river only sustained minor injuries.

Mike Allende, a state Department of Transportation spokesman, is quoted by the AP as stating of the ongoing investigation into the truck’s transporting an oversize load along the interstate, “We’re still trying to figure out why it hit the bridge… It’s ultimately up to the trucking company to figure out whether it can get through.”

New York – Legislation is being considered pertaining to the issue with people in some Oregon counties seeing their 911 calls go unanswered. As reported by CNN, Oregon Gov. John Kitzhaber is considering a measure that would allow a public safety emergency to be declared in counties in the state where this is a problem.

In addition to the declaration, a temporary income tax would also be imposed on residents in counties with budget restrictions that leave them unable to pay for public safety workers.

Amy Wojcicki, a spokesperson for the governor, is quoted in the report as saying in an email statement to CNN, “The state has an interest in maintaining a network of public safety throughout Oregon.”

New York – Charles Ramsey, who helped rescue three women from a house in Cleveland after they had been missing for several years after being kidnapped as teens, released a statement this week saying he is not endorsing the restaurants that have offered him free burgers. As reported by the Associated Press (AP), Ramsey, who was offered free burgers for life by the restaurants, and also had a burger named in his honor, stated through his attorney Friday, “I never told these people they could use my name for this.”

The free food offers were made following Ramsey’s noting in a televised interview that prior to the rescue he had been eating at McDonald’s.

Scott Kuhn of the Driftwood Restaurant Group is quoted by the AP as stating in response to Ramsey’s request that his name not be used in endorsing the burger named in his honor, “We are saddened to hear that Chuck did not take this — or the offer of so many Cleveland restaurants to give him free meals — in the spirit we intended.”

New York – A lawsuit filed against retired NFL quarterback Brett Favre over sexually suggestive texts has been settled. As reported by The Christian Science Monitor, the terms of the settlement were not released; however, an attorney for two massage therapists who brought forth the allegations that the former football player sent them inappropriate texts stated Friday that the lawsuit had been “resolved and discontinued.”

As noted in the report, Christina Scavo and Shannon O’Toole were seeking unspecified damages in the case in which they alleged they lost their jobs with the New York Jets after making complaints about the text messages they say Favre sent. The Jets have purported that the women had never been guaranteed work on an ongoing basis with the team.

Favre has been retired from the NFL since 2010.

05/23/2013 (press release: DPRi) // Iain Bruce

Manufacturing sector SMEs and startup companies have been warned that failure to protect their Intellectual Property rights means that firms across the industry are at risk of missing out on potentially lucrative commercial opportunities in the UK and abroad.

At a masterclass event hosted by CEME Innovation Centre for small manufacturing and engineering businesses, leading Intellectual Property experts from legal firm Bristows outlined the steps required to effectively protect, manage and exploit their IP assets in the face of increasing global competition. Warning that misplaced conceptions over the cost and complexity of effectively managing IP frequently motivating SMEs to ignore the issue, lawyer Fiona Nicolson told the invited audience that protecting their processes and IP rights remains one of the most important challenges and opportunities facing the sector today.

“The hard fact of the matter is that because many SMEs and startups believe that safeguarding their IP is both expensive and complex, a popular misconception has taken root to the effect that protecting these rights is the sole preserve of big companies. As a result many bury their heads in the sand on this issue, leaving themselves vulnerable to unscrupulous competitors and likely to miss out on opportunities for commercialisation, licensing and extended sales,” said Nicolson.

“It’s a serious issue that cannot be ignored, and yet is one that all small businesses have the capacity to address. Every company, no matter what size, can take steps to ensure they avoid the most common pitfalls and protect themselves and ensure they are best placed to obtain maximum value from their IP.”

Bristows report that it is not uncommon for small businesses and startups to have no Intellectual Property strategy for their business whatsoever, believing that the subject is too complex to master alone and too expensive to have handled by external experts. However most companies nowadays do have valuable IP whether it be their brand name, trade secrets, or IP in products they have developed. By following some simple rules any SME can ensure that they can avoid the most common pitfalls and protect themselves through straightforward and easily managed procedures.

Following the event, Bristows has published a Business Manager’s Guide to Intellectual Property which is particularly useful for manufacturing SMEs and which is being made available to businesses through CEME.

Nicolson added: “In many manufacturing SMEs, knowledge of products and processes often exists solely in the heads of these on the factory floor. Such processes should be documented in order to be of value to the Company, and then used as a basis to create a strategy for safeguarding company IP. Documents manufacturing processes is particularly important in the event that the company wants to move its manufacturing base to another location perhaps overseas or wishes to sell its businesses. IP issues are not as complex as they once were, and can often be managed effectively and efficiently in house if the correct steps are followed.”

Recent market developments have increased the practical and affordable routes open to small businesses seeking to protect their Intellectual Property. Also IP insurance is now more widely available to SMEs at affordable prices. Recent changes in the law also means that solicitors will be able to agree contingency fee arrangements with their clients. This may be of particular interest to SMEs. Also the UK government’s introduction of the Patent Box scheme will see companies paying reduced corporation tax for profits earned from patented technology.

Ross Clark of Oxford Innovation London, the group that manages the CEME Innovation Centre, commented:

“In the US, it’s becoming more common for shareholders to hold Boards accountable for managing the company’s IP responsibly, and the issue has made a rapid journey up the list of business priorities. Ten years ago IP may have been a niche subject, but today IP has made it all the way to the boardroom, with smart and successful companies placing IP amongst their leading operational considerations.

“Given CEME Innovation Centre’s role in supporting small and emerging manufacturing businesses, we feel it is vital that the sector’s innovative SMEs tackle this issue head on, as failure to do so at the early stages of a company’s development could prove extremely detrimental in the long term.

Texas – A parade float driver involved in a collision with a train has said he thought the oncoming train appeared to not be moving prior to the Midland crash. As reported by the Associated Press (AP), Dale Hayden, who has not spoken publicly about the November accident, spoke with federal investigators in an interview in February.

Hayden is quoted as stating to investigators, “When I looked in the right mirror, that’s when I saw the flashing lights. But at first it didn’t register. It just — to me there was just flashing lights, more flashing lights.

“But (the train) looked like it was just sitting there. It didn’t — I didn’t see it moving or anything. To me, it was just sitting there.”

Four veterans were fatally injured in the accident. Several lawsuits have been filed against Union Pacific railroad network for negligence.

Many who have lost loved ones as a result of medical malpractice have questions about their legal options in filing a lawsuit for compensation. There is often confusion about the terms used to categorize what type of case one may have and they are unsure if they should they be searching for a Concord wrongful death lawyer. Many wonder if their case is related to medical negligence, can a wrongful death attorney provide help? The short answer to this question is yes; for cases involving fatal injuries caused by medical malpractice, a Concord wrongful death lawyer can help.

Medical malpractice is used to identify a type of negligence. Wrongful death is used to reference the degree of the malpractice and how it affects the type of damages that may be awarded in a case. Although one can exist without the other, the two may go hand in hand in some instances, meaning a person may have valid grounds for a medical malpractice wrongful death case.

Loss of support and loss of companionship are other examples of hardships that may warrant the filing of a claim for compensation.

Phoenix – The jury deciding whether convicted murderer Jodi Arias will receive the death penalty were in a deadlock on Wednesday. As reported by the Associated Press (AP), jurors were instructed by the judge to keep deliberating despite being unable to reach a verdict unanimously.

Arias was convicted of first-degree murder in the death of her former boyfriend. Judge Sherry Stephens told jurors in the penalty phase of the case to determine points on which they agree or disagree and try to reach a decision.

In accordance with Arizona law, if there is a hung jury in the death penalty phase of a trial a new one must be selected to determine the sentence.

Maricopa County Attorney Rick Romley is quoted by the AP as stating of the outcome if there remains a hung jury in the case, “If that happens, this jury would be dismissed and a second jury would be impaneled, and you’d literally have to go through the whole case again.”
