Press Release Distribution (WiredPRNews.com) — The Fifth Circuit ruled for an employer in a workplace retaliation matter. Johnson v. Diversicare Afton Oaks LLC, No. 08-20827 (5th Cir. Feb. 17, 2010), available at http://www.ca5.uscourts.gov/opinions/pub/08/08-20827-CV0.wpd.pdf.

The plaintiff, an assistant director at a nursing home, failed to investigate an alleged incident of resident abuse and was suspended pending an investigation into her failure to investigate the alleged incident of abuse. Following the investigation, she was asked to return to work but declined to do so because she had already filed a retaliation claim against her employer.

Texas law protects a nursing home employee from retaliation by an employer if the employee reports a violation of law. Here, the employer moved for summary judgment, alleging that the plaintiff failed to actually make a report. Evidence showed that, while the plaintiff telephoned a Texas agency on the relevant date, she did so merely to ask a question and did not report a violation of law. Further, while the plaintiff argued that an employer can be held liable for retaliation when an employee is punished for the intent of reporting, she failed to show any causal relationship between her intent to report a violation and the retaliatory action of suspension. Accordingly, the Court affirmed the district court’s grant of summary judgment.

/ EINpresswire.com / Retail in Asia has announced the launch of its free business-to-business (B2B) website, RetailinAsia.com, providing retailers and the retail industry with the latest news from around the region and a platform for professional networking.

Retail in Asia has been created by a team of industry experts looking for a single, comprehensive source of news with an Asian perspective.

“We created the site out of our own desire to find out the latest retail industry news from around the region. There are great sites for retail industry news in Europe, the US and within some of the Asia-Pacific markets, but this is the first website in Asia to consolidate news from around the region into one easy format,” says Matt Fletcher, Managing Director of inProjectsGroup and founder of Retail in Asia.

Users of the site will have access to hundreds of stories about the Asian retail market each week, from over 120 news and industry sources. As a news provider, Retail in Asia works by aggregating stories from various websites, providing summaries and hyperlinks for readers to click through to the full story. Users can sign up for weekly or monthly newsletters tailored to their specific interests.

Topics covered on the site include store development, retail systems, consumer trends, supply chain and marketing, as well as retail sectors - among them fashion, luxury, property, health and beauty, food and beverage, lifestyle and leisure, business and finance, technology, supermarkets, and malls.

Retail in Asia is targeted at everyone from C-level executives and brand managers, to consultants and developers, to advertisers and recruitment agencies. In addition, the site provides a valuable news source, and potential entry point for international retailers interested in investing in Asia.
As a professional networking site, Retail in Asia enables users to connect with other industry professionals in the region to share news, advice and ideas.

“We’re really excited about the website and the feedback from some of the retailers already online has been very positive,” says Samantha Stevens, Editor of Retail in Asia. “By the end of 2010, we expect the site to hit over one million page views per month and have over 300,000 registered members.”

Developed by locally based integrated digital marketing agency Moni-Media, the site was six months in design and development, and still has a number of exciting features to roll out. The next phase will include searchable information on malls, city guides for the retail industry, and data and information pages with specialist advice for the retail community.

/EINpresswire.com / Amsterdam, the Netherlands, March 8 - New FODetect-Intersections from Xsight Systems Provides Foreign Object Debris (FOD) Detection and Ascription for Airport’s Critical Areas

FODetect-Intersections is a unique scalable system developed by Xsight Systems that can be implemented immediately for airports’ critical areas - intersections and other FOD hot-spots, and can easily be expanded to cover full runways, taxiways, or to cover all hot-spots and intersections throughout the airport. Following demand from the world’s largest airports, Xsight Systems announces FODetect-Intersections; the first and only product offering low cost coverage for a single or small number of locations.

Intersections are more prone to FOD occurrences due to the diverse nature of crossing taxiways; including luggage trains, cleaning vehicles, catering vehicles, and maintenance vehicles. FOD dropped at intersections can be picked up by an aircraft causing immediate damage or get dropped further along on the runway.

FODetect-Intersections is based on Xsight’s leading FAA endorsed FOD detection solution, FODetect, and in addition to offering scalable configuration, is the only multi-sensor system utilizing both radar and camera for FOD detection, proving to be the most effective technology to detect even the smallest FOD in the fastest time.

In addition to protecting airports from the risks of FOD, FODetect-Intersections provides its patent pending FOD source ascription, the unique ability to identify the source of the FOD, allowing the airport to notify aircraft and its airline of any lost mechanical parts or to otherwise identify the source causing the debris, including providing video documentation of the event. FODetect-Intersections also provides air and ground controllers with continuous awareness of intersection condition, allowing them to remotely view the actual intersection activity through the system cameras during routine operation as well as during maintenance and harsh weather.

“We are pleased to implement the FODetect ascription technology and method as it offers the airport the ability not only to rapidly detect FOD but also to identify the vehicle or aircraft that dropped the FOD and to take the appropriate preventive action” said Alon Nitzan President and CEO of Xsight Systems.

Providing a unique opportunity to be at the forefront of leading developments in technologies worldwide, Xsight Systems is proud to launch FODetect-Intersections at ATC Global 2010 and invites media to visit for further details and a product demonstration:
Xsight Systems: Thales booth, stand H300 - Hall 11 RAI Exhibition Centre

Note to Editors:
FOD events occur daily at airports around the world presenting a risk to passenger safety, disrupting airport services and causing billions of dollars in direct and indirect costs. Many FOD incidents, unlike runway incursions, result in costly aircraft damage daily and generate serious risk to safety of life or serious flight events. In fact, the referenced study* estimates airline FOD-related direct cost of US$263,000 per 10,000 movements with engine damage representing nearly 80% of that cost, followed by tire damage at over 20% and the remaining fraction related to aircraft body damage.

About Xsight Systems:
Xsight Systems is a provider of the world’s leading technologies and systems for runway situational awareness and foreign object debris (FOD) detection in airports, and advanced sensors for surveillance, security and transportation. Xsight offers millimeter wave radar, vision sensors and advanced image processing technologies for static and mobile platforms. Xsight’s FODetect(R) system introduces a novel concept for detecting foreign objects on airport ground movement surfaces. Xsight has successfully completed an extensive system evaluation with the United States Federal Aviation Administration (FAA) at Boston’s Logan International Airport.

/ EINpresswire.com / 9 March 2010, New York - Atlumin Energy, a leading supplier of minor metal-based products to solar module manufacturers, has established a partnership with Floridienne, the largest cadmium supplier and reclaimer in the world for over 30 years. This partnership solidifies Atlumin’s position as the most reliable source for the procurement, fabrication, and reclaim of cadmium containing materials. Atlumin’s partnerships with both MCP and Floridienne allow them to provide a unique turnkey solution for all minor metals used by solar manufacturers in both CdTe and CIGS technologies.

Solar module manufacturers welcome the cost and time savings that the Atlumin - Floridienne partnership enables. Previously, the supply chain involved several different organizations, each handling a piece of the cycle. Now, Atlumin sources, refines, fabricates, and supplies products. All this is done by managing regulatory details in an environment friendly closed loop system. Gregory Phipps, President of Atlumin notes: “this gives us opportunity to further compress the supply chain and create unique offerings for our customers. Our clients can focus on their core technology and development while we streamline and manage the supply chain. We are pleased that our new partnership helps solar manufacturers to minimize their capital investment and increase watts per unit cost.”

A key issue with cadmium in solar is the potential environmental ramifications, if mishandled. Atlumin and Floridienne, both are recognized leaders in clean materials handling. Atlumin has a rigorous closed loop system for all its minor metals, ensuring maximum use and reuse of these metals. Floridienne has a long-standing reputation for its zealous pursuit of clean materials processing. Simon Vlajcic, Managing Director of Floridienne notes: “the unwavering commitment of both Atlumin and Floridienne to environmental responsibility is based on known, well defined and controlled processes at work. Perhaps the most gratifying result of our new partnership with Atlumin is the ability to assure solar manufacturers and their clients that environmental issues are being managed by two highly committed companies supplying the solar industry.”

Atlumin Energy manufactures materials for the renewal energy market, including solar module manufacturers, with a focus on increasing efficiency. Atlumin products range from key elements, alloys, and specialty chemicals, to engineered fabrications, such as sputtering targets.

/ EINpresswire.com / San Jose, Calif., - The new EZ-Glider Position Control torque arms by Mountz Inc. help manufacturers detect and eliminate costly screw-fastening errors during the assembly process. Position Control torque arms are designed to reduce the risk of improperly fastened screws, ensuring that every screw is in the correctly tightened in the correct sequence. Using the EZ-Glider Position Control torque is like putting the eyes and ears of a quality control manager where they are needed most - right on the assembly area.

“Sequence based fastening is critical to proper process control and a quality fastening result for many applications,” said Brad Mountz, President of Mountz, Inc. “If an assembly exhibits cross talk, a phenomenon where torque to one faster changes the result to another in the in fastening pattern, altering the sequence is often necessary to achieve proper results. An encoded torque arm is perfect because it guides the operators sequence and provides feedback if done incorrectly.”

Assembly sequences are easily programmed for the EZ-Glider Position Control torque arms from an easy-to-use control box. Up to nine sequence programs can be stored and are manually or automatically selected for easy recall.

The EZ-Glider Position Control torque arm consists of a torque reaction arm with encoders mounted at the two pivot points and a control box. The control box is used for programming and it tracks the axis movement by converting angle counts to the precise X-Y position of the screwdriver. The X-Y location is calculated from encoder values, allowing the operator to easily teach the torque arm a programmed sequence pattern and then use it to control the assembly process. Programming is as simple as moving the driver over the sequence location and then pressing a button. Popular features are driver “lock out” which disallows activation of the driver if the wrong sequence is attempted and torque adjust, which automatically changes the driver torque to a new torque value if required.

The EZ-Glider Position Control torque arm is compatible with most air, electric screwdrivers and DC control systems. The torque arm can also interface with most intelligent driver systems that store multiple torque programs with external digital I/O control. The Mountz Position Control torque arm provides a smooth, flexible range of motion as the arm absorbs torque reactions general from clutch, stall and other electric & pneumatic screwdrivers.

Specify a Tightening Sequence: Why?
Many joints consists of more than one fastener and bringing together surfaces that are not completely flat can be a very challenging torque problem. The sequence of tightening fasteners can have a major influence on the resulting preload and clamping force, which is what holds two parts together. With such joints, consideration should be given to specifying the sequence in which the fasteners are to be tightened. Because the joint surfaces compress, tightening one fastener in the vicinity of another will affect the preload generated by the first fastener tightened. This is called Cross Talk.

A good tightening sequence ensures that an even preload distribution is achieved in the joint. Since joints containing conventional gaskets have a comparatively low compressive stiffness, bolt preloads in such joints are particularly sensitive to the tightening sequence. Based on experience, if the bolts are in a circular pattern, a cris-cross (star) tightening pattern would normally be specified. For non-circular bolt patterns, a spiral pattern starting at the middle would normally be specified. On critical joints or joints that exhibit relaxation, a tightening pattern that tightens the fasteners more than once can be specified to ensure an even preload distribution.

Specify Ergonomic Solutions: Why?
When planning a production area, it pays dividends for manufacturers in the long term to plan the ergonomics of the operation and consult a health and safety inspector or ergonomic manager. Ensuring both the workplace and the assembly operation are compatible with the majority of operators that handle the assembly tools, reduces future costs arising from work-related health disorders among operators, along with costs arising from poor product quality or lack of productivity.

Some key questions manufacturers need to ask about their production area.
- How often do your assemblers complain of fatigue or arm pains?
- How much does a typical injury cost the organization?
- How many workman comp claims have you had?
- How often does a health and safety inspector review your applications?
- What ergonomic solutions are being considered for that application?

EZ-Glider Position Control torque arms are designed to improve production and quality control during the assembly process. The ergonomic design of the EZ-Slider torque arm reduces RMI (repetitive motion injury) and CTS (carpal tunnel syndrome). The effortless handling of the torque arm provides comfortable tool operation and increased production. The Mountz torque arm eliminates torque reaction of power and pneumatic tools.

Personal injury lawyer alerts- Study reveals food contamination and foodborne illness outbreaks have resulted in $152 billion in medical costs and other expenses.

Washington, DC (News)—A new study conducted by the Produce Safety Project at Georgetown University exposed the true expenses associated with foodborne illness outbreaks…$152 billion dollars a year. Prior estimates regarding such medical-related costs, formally issued by the U.S. government, stated that expenses ranged from $7 billion to $35 billion annually. The study was released on Wednesday, March 3, 2010, according to information provided by Reuters.

While previous estimates were based on limited medical costs and pathogens, the Produce Safety Project’s study took into account 27 notorious pathogens, which included salmonella and listeria, and a broader spectrum of health-related expenses, subsequently resulting in the updated cost estimate of $151 billion a year. Food contamination threats have prompted a seemingly incessant slew of product recalls and caused many consumers to become sickened and under certain circumstances, die from these foodborne illnesses. Potential food borne illness hazards and occurrences tend to result in profit losses for manufacturers forced to recall tainted products. For instance, Kellogg Co. was forced to recall contaminated peanut butter, resulting in approximately $70 million in losses.

Such consumer health safety risks and episodes are also allegedly responsible for “medical costs, lost productivity and quality of life”, according to the study. The U.S. Centers for Disease Control and Prevention (CDC) http://www.cdc.gov noted that 76 million people are sickened as a result of food poisoning each year, with 5,000 of these illnesses tragically proving fatal. Congress is reportedly expected to work towards improving food safety legislation this year, for the first time in 50 years.

Raleigh, North Carolina (CaymanMama.com) — The esteemed North Carolina divorce and family law attorneys at Gailor, Wallis & Hunt, PLLC constantly work on behalf of their clients to keep them informed of their rights as they relate to the laws of the state.

In keeping with their commitment, the divorce law firm issued an alert as to recent changes in North Carolina alienation of affection and criminal conversation laws.

When adultery is committed in a marriage, the domino effect of emotional distress of the partner who was cheated on is ten fold. The feelings of rejection, anger, grief and humiliation as well as potential loss of financial support, depression, and other factors are considered a personal injury in North Carolina, whose public policy is against the interference of a third party in a marriage.

The state of North Carolina recognizes two causes of action that allow an injured spouse to sue for money damages based on allegations of harm to the marital relationship caused by a third party. These causes of action are for “alienation of affections” and “criminal conversation.”

In North Carolina, the statute of limitations for both alienation of affection and criminal conversation is three years. The statute begins to run at the time of the loss of affection, which is determined on a case-by-case basis.

Previously, acts between the spouse and third party that occurred after the date of separation but before absolute divorce may still in some circumstances be plausible for a claim.

However, effective October 1, 2009, a plaintiff must file a claim within three years from the earlier of (a) the date of the last act or (b) three years from the date of separation, even if the alienating behavior and/or sexual intercourse continued after the date of separation.

Also effective October 1, 2009, claims may be brought against natural persons only; business entities may not be sued for these torts.

Legal news for product liability attorneys. The family of a woman who was killed by a salmonella infection filed a lawsuit against U.F. Union International Food.

Union City, CA—A lawsuit has been filed against U.F. Union International Food on behalf of a deceased woman who died from a salmonella infection last year, which was acquired from consuming tainted pepper that was sold by the defendant. The lawsuit was filed on Thursday, February 25, 2010 in the Alameda County Superior Court in Oakland, as reported by the San Jose Mercury News.

Donna Pierce, 69, of San Leandro contracted the salmonella infection from pepper sold, manufactured, and distributed by U.F. Union International Food. Pierce was recovering from lung surgery while at Kaiser Hospital in Hayward, when she consumed the tainted pepper. Pierce died in April after loosing her battle against the bacterial infection.

According to the lawsuit, Pierce’s death was caused by last year’s salmonella outbreak, which caused infections in at least 33 Californians and 87 West Coast residents. The lawsuit also listed Foodservice Partners of California LLC and Delaware-based companies Foodservice Partners Inc., and Sysco Corporation. The plaintiff, Tamara Lucier, 50, of Huntington Beach, who is Leandro’s daughter, is seeking unspecified damages on behalf of her family, which includes reimbursement of medial and funeral expenses. U.F. Union International Food sold the tainted white pepper under several brand names.

Montreal alcohol rehab center says New York criminal attorneys can help their clients stay out of prison, recover, and save U.S. tax dollars.

New York, NY (press release)–Chatsworth a short-stay alcohol rehab center in Montreal claims with one year jail terms at $45,000 annually DUI lawyers can help their clients recover. When a DUI attorney advises their repeat offender client to enter a three week alcohol recovery program to receive the recovery help they need for their alcohol problem the criminal lawyer offers good will for all involved including great savings to U.S. tax payers. DUI attorneys and nonviolent criminal lawyers can offer the solution to their client’s binge drinking and alcohol abuse that causes them to continue to get behind the wheel of a motor vehicle and drive while impaired.

Many professionals commit illegal acts like driving under the influence (DUI) because they are suffering from a disease. Alcohol abuse and addictive behaviors like binge drinking are medical diseases and are legitimately diagnosed by mental health professionals and doctors. Unfortunately, many people who suffer from alcohol abuse go untreated and unnoticed until they break the law and land in front of a judge in the United States court system. These criminals need to be treated for their alcohol issues and because they repeatedly do not receive the recovery help they need, they continue to repeatedly drink and drive. Many repeat DUI arrests across the U.S. are because the accused criminal is suffering from alcohol addiction. Prisons and jails offer incarceration, not alcohol rehabilitation.

When people are in the throes of active alcohol abuse they participate in socially and legally unacceptable behaviors because they are mood and mind altered. The consequences of these illegal self-defeating behaviors, like driving while intoxicated (DWI) lead to arrests by law enforcement officers. Criminal attorneys across the U.S., representing DUI and nonviolent alcohol offenders are fighting to maintain their clients’ freedom but find themselves baffled by the dilemma of their client being sentenced to lengthy jail and prison terms when what they need is medical care and recovery so they will stop drinking and driving once and for all. The professionals at Chatsworth alcohol rehab in Montreal assert judges in the U.S. court system look more favorably upon the suffering DUI offender who is actively seeking help for the root cause of their illegal activity, which is the disease of addiction. Lengthy jail and prison sentences place these individuals in an already over crowded penal system at a high taxpayer cost ($45,000 per year per inmate) where they don’t receive treatment for their alcohol abuse problem.

Chatsworth in Montreal offers a solution for your clients’ repetitive and baffling self-defeating habits. Through alcohol rehab and addiction recovery by licensed mental health and addiction professionals, repeat DUI offenders can successfully return to society and stop their drinking and driving which puts innocent people at risk and costs thousands. These otherwise normal individuals go back to being the healthy people they once were as productive members of their communities and cease their repetitive self-defeating behaviors that led to their criminal activity. If your clients need help with their medical issues of alcohol abuse while you are fighting to maintain their legal rights contact Chatsworth Pavilion in Montreal for a private consultation.
