Anaheim, CA– Disney’s California theme park, Disneyland, is being sued by a quadriplegic visitor who claims he was left on a broken ride for 40 minutes, while other visitors were evacuated from the ride. The lawsuit was filed on Monday against the Walt Disney Co., accused the theme park’s parent company of violating the American with Disabilities Act, as reported by UPI.
The plaintiff, Jose Martinez said he visited Disney land on Nov. 27, 2009, when he decided to ride the “It’s a Small Word” boat ride. A computer glitch stalled the ride, which left him stranded on the boat and in his wheelchair for about 40 minutes as the other visitors were evacuated. Martinez was left on the boat while the “It’s a Small World” song played repeatedly.
While Martinez waited for help, he suffered from dysreflexia, which is a medical condition involving sudden high blood pressure that can lead to death if left untreated.
The suit claims that Walt Disney Co. failed to have adequate evacuation procedures for visitors with mobility disabilities.
A Disneyland Resort spokeswoman said “Disneyland Resort is accessible to guests with varying needs, including those with mobility disabilities. If it is necessary to evacuate an attraction, we have procedures in place for all guests.”
