Man who lost his penis in ‘peeling machine’ accident sues for negligence

Orlando, FL— A Florida man who lost his penis in an industrial accident at a foam-cutting company has now sued the company for negligence, relating to the accident. The worker was injured on January 13, 2010, at Future Foam Carpet Cushion, where he was employed as a contract worker.

The victim, Edgardo Toucet Echevarria, 44, says he was injured while removing a “foam core” from a machine, which is used to cut blocks of carpeting foam, reported the Orlando Sentinel and UPI.

Echevarria reportedly removed the foam from the “peeling machine,” which he was not trained to operate, at the request of his supervisors. The removal of the foam core activated the machine, injuring Echevarria.

“The surgically sharp steel blade sliced through Toucet’s pelvis cutting off his penis and testicles while virtually cutting his body in half,” the lawsuit alleges.

The lawsuit asserts that employees had improperly removed a protective guard from the machinery.

The suit named Baumer of America, the manufacturer of the peeler machine, as well as Future Foam Carpet Cushion in the negligence claim.

The U.S. Occupational Safety and Health Administration (OSHA) cited Future Foam for 10 serious violations as a result of the accident.
