Los Angeles, CA (Los Angeles Employment Lawyer News) — AT&T in Northern California is under fire after a class action lawsuit accused the phone company of failing to adhere to the California Labor Code by violating the rights of at-home virtual call center employees, reports Eric Grover, a Los Angeles employment lawyer at Keller Grover LLP.
According to information provided by the San Francisco Chronicle, the California employment class action lawsuit filed on March 28, 2011 in the Northern District of California alleges that the wireless giant mislabeled virtual at-home employees to avoid costs.
The class action California employment lawsuit asserts that AT&T hired at-home call center employees to provide billing and technical support for its customers. But, according to court documents, AT&T then intentionally misclassified the at-home workers as independent contractors to avoid wage & hour costs associated with Workers’ Compensation and state and/or federal taxes, which is a direct violation of California employment laws and regulations.
“By AT&T classifying its workers as independent contractors, those employees would not be covered under California minimum wage and overtime laws, which are designed to protect California workers from unscrupulous employers,” explained Grover of Keller Grover LLP, a Los Angeles wage & hour claim law firm.
The employment lawsuit claims that the at-home employees should not be classified as independent contractors, because they are still required to perform work subject to AT&T’s control, and it still has the power to control the work performed by the at-home call center employees.
In addition, AT&T still has power to control the call center employees’ work schedules and hours, providing further evidence that AT&T mislabeled its employees, stated Grover, a Los Angeles employment lawyer.
