Washington, D.C. — A civil complaint filed by a Norfolk family says a father and daughter were secretly videotaped while using the bathroom at a Starbucks location near the National Mall. The lawsuit says the family was visiting Washington in late April when they visited the Starbucks location at 7th Street and Pennsylvania Avenue NW, reported WJLA.

William Yockey and his daughter were reportedly using the restroom when they noticed a small, activated camera under the sink, which was pointed toward the toilet.

“She used the restroom…and then I was using the restroom and my daughter say to me, ‘Daddy there’s a camera,’” said Andrew Yockey, reported WJLA.

Yockey alerted Starbuck’s store manager, who called the police and offered Yockey a complimentary beverage. Police arrived and confiscated the camera.

Yockey has since filed a lawsuit that alleges invasion of privacy, negligence, intentional infliction of emotional distress and negligent hiring, training and supervision. Starbucks unsuccessfully tried to have the case dismissed.

The suit asserts the issue could have been avoided if Starbucks had conducted timely inspections of their bathrooms. In addition, the complaint contends that Starbucks employees had knowledge of the camera and their alleged illegal activity.

“We can tell you that as a part of regular store operations, we monitor the seating areas and rest rooms in our stores on a regular basis to identify potential safety or security concerns,” Starbucks said.
