Florida Day Care injury – Miami day care sued over sexual abuse!

Florida personal injury attorneys alert- Mother files lawsuit over molestation at a day care center.

Miami, FL—The mother of the 5-year-old girl who was sexually assaulted at a day care facility filed a lawsuit against the Discovery Day Care Inc. The lawsuit, which accuses the day care operators of negligence, was filed on Tuesday, September 1, 2009 in the Miami-Dade Circuit Court, as reported by the Miami Herald.

The lawsuit claims in 2008, a 13-year-old boy identified as “R.S.” who is reportedly the son of the day care center’s assistant director, repeatedly forced the little girl to perform oral sex on him 10 different occasions during nap time at the facility. When R.S. tried to force himself on another pre-school aged girl during nap time she told her mother, who then called the police. The suspect reportedly pleaded guilty in February to two counts of battery, and was sentenced to adolescent sexual behavior counseling, 100 hours of community service, curfew, received a stay-away order, and probation until February 2011. The lawsuit alleges Discovery Day Care should be held responsible for neglecting to supervise and protect the two young girls from the molestation they experienced from the directors son. It is unknown why the boy was not attending middle school, when he sexually abused the girls. The plaintiff is seeking monetary compensations for their damages. The family-owned day care facility reportedly still open and continuing to care for children.
