New York – Lawsuits have been filed against Viacom and Google for purported privacy violations of users under the age of 13. As reported by Online Media Daily, the potential class action suits purport the companies have violated the Video Privacy Protection Act as well as federal wiretap law with the implementation of cookies that track online viewing by children.

The VPPA prohibits the disclosure of personally identifiable user information by video rental services with written consent. The lawsuits allege user information is disclosed with the tracking of videos viewed by users under 13 on Nick.com and NickJr.com with Google’s DoubleClick cookie.

As noted in the report, the lawsuits appear to be the first of video privacy cases that place an emphasis on users who are under the age of 13.
