New Mexico – The New Mexico Supreme Court recently ruled in a decision linked to a case involving the dismissal of a juror with limited English speaking skills, reminding judges and attorneys non-English speaking citizens are allowed to serve on juries according to the state constitution. As reported by FindLaw, the court refused to overturn a first-degree murder conviction of a man on the basis of the juror’s decision, but agreed that the reason for the juror’s dismissal was in violation of the state constitution.
Justice Charles Daniels is quoted as writing in the court’s opinion, “Accordingly, while we affirm defendant’s convictions, we stress to trial judges and lawyers that they have a shared responsibility to make every reasonable effort to protect the right of our non-English-speaking citizens to serve on New Mexico juries.”
