Time Warner Cable Accused of ‘Systematic Wage Theft’ in Employment Lawsuit

A lawsuit has charged Time Warner Cable (TWC) with “systematic wage theft,” after 10 current and former employees alleged that they were denied overtime pay and weren’t fully compensated for their time on the job, reports San Francisco wage and hour lawyer Eric Grover.

The lawsuit was filed on behalf of about 400 workers in the U.S. District Court in Denver on Monday, September 16, 2013.

According to the lawsuit, the employees said TWC requires them to “work in excess of 40 hours per week without paying them overtime compensation.” The plaintiffs also allege that they were often required to work through their breaks and had to report to work “20 to 30 minutes or more prior to their start time” to start computers and log onto necessary programs prior to clocking in.

The Colorado Springs center reportedly receives continuous customer calls and often requires extensive paperwork that mandates that employees work through their 15-minute unpaid breaks as often as two to three times a week, as well as after their shifts.

The plaintiffs are seeking owed wages under the Colorado Minimum Wage Order and Fair Labor Standards Act. In addition, they’re seeking monetary damages “equal to the unpaid overtime compensation, pre-judgment and post-judgment interest on those wages, attorneys’ fees and costs, and such other relief as the Court sees fit to award,” court documents revealed.

“Heavy work loads and pressure from employers to get the job done often causes workers to stay off-the-clock long after their shift has ended and work through their breaks for fear of losing their job,” says San Francisco employment lawyer Eric Grover. “This often causes employees to look past their employment rights and work as requested, even if that means that they are forgoing proper payment. This practice is not only unfair, it’s illegal. If your employer is taking advantage of you, speaking to an experienced employment lawyer is the first step in the fight for justice.”
