Judge dismisses lawsuit over 67-cent Chase card overpayment

New York – A Manhattan federal judge recently dismissed a lawsuit over a 67-cent overpayment on a JPMorgan Chase & Co credit card holder’s bill. As reported by Reuters, Stanley Epstein filed the suit in 2013 after Chase took away a 67-cent positive balance he had remaining on his Chase Marriott Rewards card, alleging it was a breach of his cardholder agreement.

Chase reportedly reimbursed Epstein the amount in a cashier’s check four months prior to his filing the lawsuit; however, he alleged he did not cash it or have any intentions to. The suit was seeking class-action status.

U.S. District Judge Katherine Polk Failla dismissed the case citing the plaintiff’s lack of standing to sue alone or on behalf of other individuals in the matter.

Failla is quoted as writing in a 26-page decision, “The court cannot accept plaintiff’s contention that by neither requesting nor cashing the refund check, he has somehow created standing.”
