Supreme Court declines to review appeal of employee drug testing case

Washington – The U.S. Supreme Court has declined to review an appeals’ court ruling over random drug testing for workers in Florida. As reported by Reuters, the high court’s decision will allow the ruling of the 11th U.S. Circuit Court of Appeals last year regarding Florida Governor Rick Scott’s executive order to remain intact. The appeals court determined that the governor’s order was too broad and that he could not make it a requirement that all employees be subjected to the tests.

Scott released a statement on Monday defending the policy stating, “State employees should have the right to work in a safe and drug free environment, just like in any other business.”

The executive order was issued in 2011 and aimed at all 85,000 state workers in Florida. The American Federation of State, County and Municipal Employees challenged the order stating it was a violation of the U.S. Constitution’s Fourth Amendment.
