Montana – BNSF Railway has been ordered by the Occupational Safety and Health Administration to reinstate two workers whose employment had been terminated after they reported being injured at work. As reported by the Associated Press (AP), the agency deemed the employees’ firing was illegal following an investigation.
OSHA stated Monday that the railroad network was in violation of the whistleblower portions of the Federal Railroad Safety Act in firing two men, one in 2010 and another in 2011, when they reported suffering back injuries on the job. BNSF has also been ordered to pay $6,000 in damages in addition to lawyers’ fees and back pay for each of them.
BNSF, which is based in Fort Worth, Texas, is quoted by the AP as saying in a statement of its plans to appeal the decision, “These allegations against the railroad are not true. At trial, the evidence will show that BNSF acted appropriately and in accordance with the law.”
