Missouri – Some Missouri business leaders have taken issue with a state Supreme Court ruling concerning punitive damages. As reported by the Associated Press (AP), some fear the future impact of the court ruling, which allows unlimited punitive damages in a specified class of lawsuits.
The court determined in it’s ruling that the state’s 2005 law that caps punitive damage awards to $500,000 is not applicable in cases of common-law injury claims. In its decision, the $1 million award of a woman who filed a lawsuit against a car dealership for fraud was reinstated.
The Missouri association of lawyers president has asserted that in spite of the fears of business owners, the impact of the decision is expected to be limited due to the state high court’s determination that it would not apply to statute based claims.
