Luxembourg – The Court of Justice of the European Union has ruled that embedding copyrighted videos in online content is not in violation of copyright law. As reported by the Torrent Freak, the landmark decision was made regarding the case of a dispute between a water filtering company that accused two independent commercial agents of embedding their promotional video without permission.
The video, which was viewable on YouTube, was embedded on the personal website of the two men. The Court argued that in accordance with European law, embedding a video file or video is not an infringement on the copyrights of the creator.
The Court’s verdict is quoted as reading, “The embedding in a website of a protected work which is publicly accessible on another website by means of a link using the framing technology … does not by itself constitute communication to the public within the meaning of [the EU Copyright directive] to the extent that the relevant work is neither communicated to a new public nor by using a specific technical means different from that used for the original communication.”
