Mississippi – A new lawsuit filed by a Mississippi family alleges that the anti-nausea drug Zofran caused their daughter to develop a cleft palate. The Legal Examiner reported that the lawsuit was filed against drugmaker GlaxoSmithKline in the US District Court for the Southern District of Mississippi, Western Division. The parents are believed to be the first to file this type of claim in Mississippi Federal Court.
The child was born in January 2015 and diagnosed with a soft cleft palate shortly after. With the condition the muscular part of the roof of a patient’s mouth splits, and can have an effect on their breathing, speech, and eating.
The mother of the child claims that she took Zofran during the first trimester while pregnant. The medication has been prescribed for patients suffering from morning sickness as an “off label” treatment.
According to the report, research has found the drug is linked to birth defects. The Justice Department charged GlaxoSmithKline in 2012 for marketing Zofran to gynecologists and obstetricians as a treatment for morning sickness.
