U.S. retailer appeals $2 million Massachusetts discrimination lawsuit

Pittsfield Wal-Mart appeals million dollar sex discrimination jury verdict.

San Francisco, CA (JusticeNewsFlash.com)–Massachusetts Supreme Court hears arguments on Thursday on the sexual discrimination lawsuit of Chythia Haddad versus Wal-Mart. The former female Wal-Mart pharmacist won a sexual discrimination lawsuit against the nation’s largest retailer after her Wal-Mart supervisors fired her in April 2004. Haddad had been employed as a pharmacist at the Pittsfield, Massachusetts Wal-Mart for over 10 years until she requested to be paid the same as her fellow male pharmacists. She was then promptly fired.

The Berkshire Superior Court heard her claims and the jury returned a verdict in 2007 awarding almost $1 million in compensatory damages and $1 million in punitive damages. Wal-Mart appealed. During the first round of appeals, in the Massachusetts appellate court system, a judge upheld the compensatory damages and revoked the jury’s punitive damages. Haddad’s lawyers appealed the punitive damages reversal to the Supreme Court.
