ADEQ and Arizona lawyers file legal action against Kuhles Captial in Maricopa County.
Phoenix, AZ (JusticeNewsFlash.com)–The Arizona Department of Environmental Quality (ADEQ) www.azdeq.gov and the Arizona Attorney General’s Office have filed a lawsuit in Maricopa County Superior Court alleging Kuhles Capital, LLC violated state asbestos abatement regulations. Kuhles Capital is charged in court documents for asbestos violations at its landfill near Dewey-Humboldt in Yavapai County.
Lawyers for the state of Arizona filed 10 counts against the company for continuing to demolish its closed Yavapai County landfill without proprely surveying the dumpt for asbestos-containing materials. ADEQ state regulators found construction workers and demolition laborers handling, demolishing and removing asbestos containing materials without wetting, covering, and placing the asbestos laden products in properly labeled containers, which is in direct violation of federal and state laws.
In February 2008, ADEQ inspectors issued an Order of Abatement after they discovered the company had been demolishing structures like siding material, roofing paint, and floor tiles laden with asbestos, since July 2007, in direct violation of federal asbestos abatement laws. The company did not have at least one on-site employee trained in the removal of asbestos fibers as required by federal regulations.
Asbestos is known to cause cancer and respiratory illnesses and diseases like meosthelioma cancer in consumers and workers who are exposed directly or indirectly (secondary exposure) to asbestos containing products.
There is no safe exposure level to asbestos and the greater the exposure, the greater the risk of developing an asbestos-related illnesses and diseases.
