Indiana medical device company settles WV medical malpractice claims

Biomet settles West Virginia medical malpractice lawsuits involving bone stimulator surgeon.

Charleston, WV(JusticeNewsFlash.com)–Biomet, a medical device manufacturer company, whose EBI subsidiary was sued by 27 different medical malpractice plaintiff’s lawyers, agreed to settle 24 of the recent legal actions. EBI, the maker of the Ionic Spine Spacer System and its SpF and OsteoGen implants, was listed as a defendant by 27 injured victims who claim they were provided negligent treatment by Dr. John King, a former West Virginia osteopath. The settlement agreement awaits final approval by the Putnam County residing judge reports Business Week.

According to legal documents filed by medical malpractice attorneys, King misdiagnosed, injured and even killed some 120 patients after he implanted the EBI made bone stimulators, at the former Putnam General Hospital who employed him as a surgeon for a six month period in 2002. Biomet and its subsidiary EBI, the medical device manufacturer based in Indiana, admits no wrong doing in the settlement agreement. Biomet entered a mandatory regulatory filing with U.S. Securities Exchange Commission (SEC) www.sec.gov on Monday and expects to take an after tax charge of $39 million in their fourth quarter after setting aside funds related to the Dr. King medical malpractice lawsuits.
