Personal injury lawsuit filed against Massachusetts Bay Transportation Authority

Legal news for Boston personal injury lawyers. Two injured victims sue trolley driver, Aiden Quinn and MBTA for negligence.

Boston, MA—The Massachusetts Bay Transportation Authority (MBTA) and the trolley driver of the May 8, 2009 Green Line crash have been named in a personal injury lawsuit by two injured women. The lawsuit charges both the MBTA and Aiden Quinn with negligence, as reported by the Boston Globe.

The two women filed the lawsuit in the Suffolk Superior Court last month, which seeks an undisclosed sum. The plaintiffs, Rebecca Bishop, of Lynn broke her pelvis in the crash, and Jennifer Levi, of Brookline who is pregnant suffered a broken wrist. Attorneys representing the two injured victims claim Quinn negligently operated the trolley, and the MBTA did not properly check Quinn’s driving record. The MBTA also failed to establish policies, which could have prevented MBTA drivers from carrying and using cellular devices while on the job. In addition, the lawyers said the MTBA lacked sufficient safety systems, which could have prevented the tragic crash.

After the train crash, attending doctors and nurses were unable to detect a heartbeat in Levis unborn baby for several hours. Levi was in her third trimester when she was injured in the crash. Doctors treating Levi stated they are unable to determine if the unborn child suffered any long-term harm until they baby is born.
