April 7, 2010 – Nevada Gov. Jim Gibbons wanted his state to join a lawsuit filed by more than a dozen states to sue the federal government over the new healthcare legislation. State Attorney General Catherine Cortez Masto declined to include Nevada as part of that suit. So, Gibbons instituted his plan B: Hire someone else to represent the state.
Gibbons announced he would sidestep Cortez Masto and retain private counsel to challenge in court the constitutionality of the federal healthcare mandate.
“This healthcare nationalization plan is illegal because it is unconstitutional,” Gibbons said.
Cortez Masto said Gibbons had no authority to name outside counsel. “My office is now in the regrettable position of having to consider the necessary legal options to take in response,” she said.
