The coal producer is being sued by a pension fund.
West Virginia (WiredPRNews.com) – Massey Energy Co. is being sued by a pension fund following an accident last month that resulted in the deaths of 29 workers. As reported by Bloomberg.com, New Jersey Building Laborers Pension Fund filed a complaint against the large coal producer for purported failure to address safety concerns prior to the accident.
The fund is quoted in the report as citing in the complaint, “Given Massey’s chronic unwillingness and failure to adhere to mining safety regulations, this tragedy did not come as a surprise to many.” A request for the removal of Massey Chief Executive Officer Don Blankenship was also reportedly made.
As noted in the report, the explosion on April 5 near Montcoal, West Virginia at the Upper Big Branch mine reportedly caused the highest number of fatalities of any mining accident in the U.S. in the past 26 years.
