Philadelphia PA Premises Liability: PHA to pay $9.68MM to settle TBI lawsuit

Philadelphia, PA— The Philadelphia Housing Authority (PHA) has agreed to settle a lawsuit by paying the family of a teenage girl who sustained a debilitating traumatic brain injury (TBI) $9.68 million to be put towards her care. The lawsuit contended the PHA was negligent with regard to maintaining adequate living conditions in the public housing apartment where the victim lived. As a result, she suffered a mold-induced asthma attack, consequently leaving her with incapacitating brain damage, according to information provided by Philly.com on Tuesday, May 4, 2010.

According to the lawsuit, the PHA was allegedly conscious of the unsafe conditions at the apartment complex. However, the association continued to provide the landlord with full rent and also established a regulation that required all tenants to provide 30 day’s notice before moving out. The PHA’s actions apparently left Gage “more vulnerable to harm”, under the provisions of a federal statue known as a “state-created danger”. In doing so, Gage’s civil rights were reportedly violated. Gage was only 12-years-old when she suffered an asthma attack that resulted in an unfortunate TBI.

According to the attorney representing the Gage family, “Ebony can’t walk… She can’t talk. She can’t make her needs known. I am satisfied this settlement will let her mom get her the care she needs and deserves.”

While an official from the PHA did not provide a comment with regard to the matter, they have agreed to pay $9.68 million to settle the case.

Artur Realty, the property management company to which the PHA was paying rent, will also reportedly pay $2 million to settle the litigation as well.
