May 11, 2010 – Supreme Court nominee Elena Kagan has publicly criticized the US military’s Don’t Ask, Don’t Tell policy as discriminatory as an employment policy, but on a similar gay rights issue, the solicitor general has been publicly less supportive of gay marriage.
In 2009 during her confirmation hearing to become solicitor general, Kagan was very succinct about gay marriage, telling Sen. John Cornyn, “There is no federal constitutional right to same-sex marriage.”
But the question being raised by conservative groups is if Kagan was merely restating the law in her answer or giving her opinion on the subject. The president of the National Organization for Marriage, Brian Brown, made a preemptive strike Monday, sending out an email that read “a vote for Elana (sic) Kagan is a vote to impose gay marriage on all 50 states.”
