Pomeroy OH Mesothelioma News: Wrongful Death Lawsuit Claims Asbestos Exposure

Pomeroy, OH—A wrongful death lawsuit, the first of its kind to be filed in Meigs County Common Pleas Court, claims exposure to asbestos products in the late 1960’s and early 1970’s caused a woman to develop mesothelioma cancer. The lawsuit, filed last week on behalf of the victim’s husband, named 26 companies as defendants, according to a Nov. 1, 2010 My Daily Sentinel report.

Charles Valentino, of Dublin, brought on the wrongful death litigation after his wife Margaret Valentino’s case of mesothelioma proved fatal in August 2009, two months after she was diagnosed with the rare disease.

The National Cancer Institute defined mesothelioma as “a disease in which cells of the mesothelium become abnormal and divide without control or order.”

The lawsuit claims Mrs. Valentino “was exposed to asbestos, products containing asbestos or machinery using asbestos products” while employed as a nurse at three different hospitals in the Columbus region. The hospitals included St. Anthony’s Hospital, Mount Carmel Health and St. Ann’s Hospital.

Allied Corporation, which is a successor of Cleveland-based Bendix Corp., was named as the primary defendant in the pending wrongful death case. Twenty-five other companies were also sued.

The lawsuit contends the defendants were liable for Valentino’s exposure to asbestos, a dangerous substance linked to several adverse health issues, including mesothelioma, lung cancer, asbestosis, and other diseases.

The suit, which seeks unspecified compensatory damages, also alleges “liability for her illness and death, breach of warranty, product liability, conspiracy, concealment and willful misconduct.”

The case is underway.
