Botched Spinal Surgery Spurs Med Malpractice Suit Against Bellaire TX Doctor

Bellaire, TX—A medical malpractice lawsuit was filed in Harris County District Court Tuesday, Dec. 14, 2010, claiming negligence and gross negligence on the part of a Bellaire surgeon and his practice. The doctor was sued after a spinal operation left a patient permanently paralyzed and unable to control some of his muscles, as reported by UltimateBellaire.com.

According to the lawsuit, which seeks both punitive and compensatory damages, Kerry Jelks hurt his neck when he fell in 2007. Jelks responded to Navin Subramanian, M.D., and Orthopedic Associates, located in Bellaire, to be treated for his neck injury.

Subramanian performed a surgical procedure, in which he removed a disk from Jelk’s spine and replaced it with fixed metal hardware. At some point during the spinal surgery, the doctor allegedly tore the dura around the patient’s spinal cord.

Jelk was left with limited muscle control and permanent, though partial, paralysis.

The extent of exemplary and non-economic damages being sought out in the medical negligence lawsuit was not specified. Also, the surgeon did not comment on the pending medical malpractice litigation.

The case is underway.
