Indoor Chicago Theme Park Sued Twice for Fatal Roller Coaster Accident

Norridge, IL — Two lawsuits have been filed against a suburban Chicago theme park after a toddler fell to his death from a roller coaster. The parents of the toddler filed a lawsuit on Tuesday, April 19, 2011, and another unrelated lawsuit was filed by a woman, who came to the aide of the child after he fell, reported the Huffington Post.

Both lawsuits named Go Bananas indoor amusement park in Norridge, Illinois as the defendants. The two lawsuits are claiming the park’s negligence led to the child’s death.

Marion Grant, a woman who helped 3-year-old Jayson Dansby after he fell from the Python Pit roller coaster, is suing for emotional distress following the accident. Grant was “standing near where he died at the time of the accident, and witnessed his injuries, the sight of which allegedly caused her emotional anxiety and distress,” the Chicago Sun-Times reports.

According to police officials, Jayson Dansby of Dolton was sitting near the front of the Python Pit roller coaster, when he got underneath the ride’s safety bar and fell out while the ride was moving. The Cook County medical examiner ruled the death an accident. Dansby sustained multiple injuries, including a head injury, in the fatal accident, as previously reported in “3-year-old Killed in fall from Roller Coaster at Chicago Indoor Amusement Park.”

Jason and Lisa Dansby have filed a wrongful death suit against the park, which is seeking undisclosed damages.
