San Diego to Pay $1.8M for Motorcycle Accident that Killed El Cajon Man

San Diego, CA — The family of a motorcyclist who died in an accident at a notorious intersection near Little Italy has reached a $1.8 million settlement with the city of San Diego, reported Sign On San Diego.

The wrongful death lawsuit was filed after El Cajon resident Kenneth Charles Sully, 58, was killed in April 2009 at the intersection of Pacific Highway and Cedar Street, which is known to be accident-prone.

Sully was reportedly riding a Ducati motorcycle on northbound Pacific Highway at around 10 p.m. The Toyota, driven by a 17-year-old Los Angeles girl, was headed in the opposite direction and made a left turn on Cedar Street, in front of Sully’s motorcycle. Sully attempted to veer out of the way, but he struck the rear passenger side of the vehicle. Sully died from traumatic head injuries, according to court documents.

The $1.8 million settlement was made on Tuesday, June 7, 2011, which is less than the original asking price of $5 million.

The lawsuit asserted, “This turn lane’s position combined with the position of the then existing traffic signals gave drivers the confusing illusion they had the right-of-way on a green signal to turn left onto Cedar Street…The city further failed to install or maintain any signs warning southbound traffic they were required to yield to northbound Pacific Highway traffic when turning onto Cedar Street. No warnings or signals were present to safely guide traffic using this intersection with due care.”
