Port Kent Construction Accident Kills Vermont Man; OSHA Investigating

07/21/2011 // WPB, FL, USA // Personal Injury Lawyers News // Nicole Howley

Port Kent, WA — A Vermont construction worker was killed after being ejected from a machine and pinned to the ground at a railroad bed near Lake Street in Port Kent. The fatal construction accident took place on Monday, July 18, 2011, at about 10:30 p.m., reported the Press-Republican.

New York State Police reported that 46-year-old Michael B. Loyer of South Burlington, Vermont, was operating a Barbco auger while installing a large pipe, which was about 3-feet in diameter, when the machine became bound in the pipe. When the auger became stuck in the pipe, it ejected Loyer from the machinery before pinning him under the heavy piece of equipment.

Noah Rounds, another construction worker at the site, used a backhoe to lift the auger off of Loyer and pulled him to safety.

Responding emergency crews rushed Loyer via ambulance to CVPH Medical Center for treatment of life-threatening injuries. But, a short time after arriving at the hospital, his injuries proved fatal.

Trenchless Technologies of New England reportedly employed Loyer, which is a subcontractor for Steven E. Fuller Excavation.

An autopsy has ruled Loyers death as “accidental.”

The New York State Police and the U.S. Occupational Safety and Health Administration (OSHA) are investigating the fatal construction accident.
