San Diego, CA (Los Angeles Employment Lawyer News) — A $160,000 settlement has been reached in a disability employment discrimination lawsuit brought against Target Corp., by the U.S. Equal Employment Opportunity Commission (EEOC) on behalf of a cart attendant, who claimed Target failed to provide reasonable accommodations for his medical condition at an Orange County store, reported Los Angeles employment lawyer Eric Grover, of Keller Grover LLP.
The disability employment discrimination lawsuit was filed in 2009 by the EEOC on behalf of Jeremy Schott, who suffers from cerebral palsy. Schott was hired by Target in 2002 as a part-time stocker and later was made a cart attendant in 2003 at his request, after being named “Target Hero of the Month,” according to information provided by 10News.
According to court filings, Schott has limited intellectual functioning and suffers from seizure disorder. After he took a medical leave in 2004 because of a seizure, he returned to working shorter hours, which sometimes were as few as eight hours per week, said the Los Angeles employment law attorney, Eric Grover.
Due to the Schott’s disabilities, he had to be reminded to complete tasks while at work. A job coach was present when Schott was at work, which would help Schott with his duties at times and would accompany him to job-related meetings.
While the disability employment discrimination lawsuit stated that Schott succeeded early into the job—due to his job coach—Target later neglected to ensure there was a job coach during work-related and job performance meetings, reported Grover, a Los Angeles employment lawyer.
Under the disability employment discrimination lawsuit settlement agreement, Target is required to instate an American Disabilities Act coordinator at the corporate level, as well as creating a companywide policy regarding requests for reasonable accommodations for disabled employees. In addition, Target will train executive team leaders and lead employees on handling requests for disabled employees.
The settlement also requires Target to submit reports to the EEOC about complaints of disability discrimination within the corporate district encompassing the Orange County Target store, stated Eric Grover, Los Angeles employment law attorney.
“Employers can easily keep themselves from facing a similar disability employment discrimination lawsuit by keeping clear channels of communication open between the management and their disabled employees. Daily meetings between the employer and their disabled employees can help to meet the reasonable needs of their handicapped employees and keep their employee feeling as if they are part of the workplace ‘team,’” explained Los Angeles employment lawyer, Eric Grover.
