San Francisco, CA (Bay Area Employment Lawyer News) — Alleged violations of California’s overtime and employment laws have prompted employees of the coffee mega-giant, Starbucks, to file a class action employment lawsuit against their employer in the Santa Clara Superior Court, reports San Francisco employment attorney, Jeffrey Keller of Keller Grover LLP.
According to the California class action employment lawsuit documents, Starbucks is accused of unfair competition, failure to pay Baristas minimum wages and overtime wages, as well as failing to provide accurate itemized wage statements. In addition, Starbucks is charged with failing to pay the Baristas for reviewing, memorizing and completing Starbucks’ training materials related to the menu and customer service, which plaintiffs’ claim is compensatory training time.
The plaintiffs assert that upon being hired, they were required to attend mandatory training, which was conducted at a location other than Starbucks retail stores. During this time, Starbucks allegedly inaccurately recorded their time, which caused the employees to lose compensation at the applicable minimum and overtime wages for the unpaid training—a direct violation of California employment laws, stated the Bay area employment lawyer, Jeffrey Keller.
“California employees are entitled to be paid for every hour they are under the control of their employer. For every hour worked beyond eight hours in a single workday, or 40 hours in a workweek, the employer is bound by California employment laws to pay their employees overtimes wages. California employment laws also mandate that employees be compensated for all mandatory training, which includes off-the-clock training that may include menu tests, or customer service training. It is illegal for an employer to deny its employees compensation for attending and completing such training seminars, as well as failing to compensate them for overtime work,” explained Keller, a San Francisco employment lawyer.
