Chicago, IL — An Oak Park nursing home is being targeted in a lawsuit filed by the family of a former resident, who died after a physical altercation with another resident. The wrongful death lawsuit was filed on Wednesday, March 7, 2012, in Cook County Circuit Court, which accused the nursing home operators of failing to protect patients and provide adequate supervision, the Chicago Tribune reports.
On Feb. 14, 80-year-old Anibal Calderon, who suffers from Alzheimer’s disease, died from head injuries he sustained after allegedly being assaulted by a 66-year-old patient at the Oak Park Healthcare Center. The altercation occurred two days prior to Calderon’s death.
The Cook County medical examiner’s office ruled Caldron’s death as a homicide.
The lawsuit accuses the Oak Park Healthcare Center of violating federal and state nursing home regulations in failing to protect patients. In addition, the suit also alleges that the facility failed to promptly report and investigate all suspected physical assaults and abuse.
No one has been charged in his death at this time.
The plaintiff’s attorneys also assert that the other resident involved in the dispute had a “violent criminal record.” Police would only comment that the man has a criminal background.
The case remains under investigation.
