Maine high court hears transgender student case

Bangor, Maine – Maine’s Supreme Court heard arguments this week in the case of a transgender student who was required to use a staff bathroom at school following a complaint about her using the girl’s restroom. As reported by the Associated Press (AP), the issue in the case is whether the actions of the Orono school district were in violation of the Maine Human Rights Act prohibiting sex or sexual orientation based discrimination.

The case is stated to raise several questions regarding the rights of transgender students in addition to whether they should be allowed to choose their preference in using school restrooms designated for males or females.

Jennifer Levi, director of Transgender Rights Project for the Gay & Lesbian Advocates & Defenders, is quoted by the AP as stating of the case, “At the core of this case is whether the promise of equal educational opportunities for transgender students is realized.”

The case stems from a 2009 lawsuit filed by the family of Nicole Maines, who is biologically male, but identifies as a female, and the Maine Human Rights Commission.
