California – A judge has denied a California city’s attempt to shutdown production at a Sriracha hot sauce plant. As reported by the Associated Press (AP), Los Angeles Superior Court Judge Robert O’Brien denied the request by the city of Irwindale for a temporary restraining order to shutdown production at the Southern California factory over complaints about emitted odors.
Irwindale filed the lawsuit on Monday asserting numerous complaints had been received from residents purporting the smell from the Huy Fong Foods plant has given them headaches, and caused burning in their throats and eyes.
The judge is quoted as stating to attorney June Ailin, who represents the city, suggesting insufficient time had been provided for hearing the case, “You’re asking for a very radical order on 24-hour notice.”
O’Brien reportedly set a hearing for Nov. 22 to consider whether a preliminary injunction may be issued.
