Saudi Arabia reinstated by U.S. court in Sept. 11 lawsuit

New York – An appeals court has reinstated Saudi Arabia as a defendant in a lawsuit stemming from the terrorist attacks on September 11, 2001. As reported by the Associated Press (AP), a three-judge panel of the 2nd U.S. Circuit Court of Appeals made the ruling Thursday claiming the country had provided support to al-Qaida prior to the attacks.

The panel deemed the reinstatement necessary to maintain consistency with a different 2nd Circuit panel’s ruling in allowing a lawsuit filed against Afghanistan and other defendants for the death of a victim of the attacks.

A determination was previously made by the 2nd Circuit and a lower court that Saudi Arabia was protected by sovereign immunity; however, the court cited a legal exception that would allow the country to remain a defendant.

Michael Kellogg, an attorney for Saudi Arabia, is quoted by the AP as stating, “It is extremely unfortunate and burdensome that a sovereign nation and ally of the United States will continue to have to litigate this matter more than 10 years after it was filed.”
