U.S. makes request that top court not extend contraception exemption

Washington – The U.S. has asked that the Supreme Court not extend a contraception exemption from part of the Affordable Care Act for Roman Catholic-affiliated groups. As reported by Reuters, the request on Friday followed Justice Sotomayor’s decision Tuesday night to grant a temporary injunction preventing the enforcement of a mandate within the law to two groups while litigation continues.

The government said in its filing that the lawsuit filed by the Little Sisters of the Poor and Christian Brothers Services had no basis due to the insurance plan at the center of the matter being a “church plan,” under which the government cannot force contraception coverage to be provided.

As noted in the report, there is no deadline for the government to take action in deciding whether the injunction will be extended.
