Texas – Lawyers for a Texas man who has remained in prison 30 years after his conviction was overturned have asked a court that he be freed. As reported by the Associated Press (AP), in a recent court petition, attorney Jeffrey Newberry stated that evidence deemed to have been key in the state’s obtaining a conviction against Jerry Hartfield is now missing.
Hartfield was convicted of murder in 1977, but his conviction was overturned in 1980. His death sentence was later commuted to live in prison, and he continued to be detained. Courts in 2006 determined that since the conviction was overturned, there was no longer a sentence to commute and ruled that he be retried or released.
He is set to be retried in April and has maintained his innocence.
