Daytona Beach, FL – A Daytona Beach appeals court has upheld the adoption rights of a lesbian mother. As reported by The Orlando Sentinel, the Fifth District Court of Appeal ruled in a 3-0 decision that a Seminole County judge who undid an adoption in the case of a two-mother family made a wrong conclusion.
The decision stems from the case of two women who agreed to go to court and each adopt the child delivered by one of them. A short time after the adoption was granted, the women split up and the mother who gave birth to the child requested that a different court nullify the other’s adoption. The child, a boy, is now 6.
Beth Littrell, a senior attorney with Lambda Legal Defense & Education Fund, an advocate for gay rights, is quoted in the report as stating that the ruling is a “grave injustice. … I am elated, first and foremost, because this reunites a mother and her son who have been kept apart for a year-and-a-half.”
