No delay in Tracy Morgan lawsuit

New Jersey – A judge has ruled against the request of the driver involved in a fatal truck crash that seriously injured comedian Tracy Morgan to delay Morgan’s lawsuit. As reported by The Wrap, Wal-Mart driver Kevin Roper sought to delay the federal lawsuit even though he isn’t a named defendant in it due, claiming it could impact his right to a fair trial.

U.S. District Judge Michael Shipp determined that the parties involved in Morgan’s suit may be unfairly impacted by a delay and that Roper’s assertions were not supported by relevant case law.

Shipp is quoted as writing of the matter in legal documents, “Roper contends that the media attention this case has attracted is tainting the pool of potential jurors in his criminal suit… These concerns, however, are more appropriately addressed by the court overseeing his criminal action, which has various trial management techniques [that it can employ] to assure that the defendant’s right to an impartial jury is not compromised.”

Roper is currently on bail after pleading not guilty to one count of death by auto and multiple counts of assault by auto.
