Philadelphia – A wrongful death lawsuit has been filed by the family of a woman killed by an amphibious tour boat in May. According to an Associated Press report, attorneys for the family of Elizabeth Karnicki allege that the accident, which occurred on a street during rush hour, was in part a result of significant blind spots on the vehicle. The Ride The Ducks vehicle is a boat used for sightseeing on both streets and waterways.
Ride the Ducks released a statement saying that a citation was not issued in the incident “and the police indicated Ride The Ducks was not at fault.”
Attorneys for the plaintiffs said the vehicle driver was “more conversational tour guide than focused vehicle operator.”
Robert Mongeluzzi, whose law firm represented plaintiffs in a fatal duck boat accident on the Delaware River in 2010, said the vehicles should be prohibited from the streets of Philadelphia. In the 2010 crash, which led to the deaths of two tourists, the tug pilot received a one-year prison sentence after being on his cell phone when the incident occurred. A $17 million settlement was reached in the case.
In the recent lawsuit, the city and other defendants have also been named.
