Oklahoma – A lawsuit has been filed against pharmaceutical giant Johnson & Johnson Inc. and subsidiary Janssen Pharmaceuticals Inc. over the anti-psychotic medication Risperdal. According to a report by Law360, the suit claims the companies misbranded the drug and failed to disclose risks posed to elderly patients.
The lawsuit was initially filed in Sequoyah County Court in April; however, it has since been moved to Oklahoma federal court. The tribe claims that the companies admitted to selling the drug for unapproved uses more than a decade ago, during the time that it purchased it.
The Cherokee Nation stated in its complaint, “Defendants engaged in methods, acts and practices with the intent to defraud the Cherokee Nation, its health care providers, prescribers and medical assistance programs, Tribal elder persons and disabled persons.”
The suit is claiming negligence, unjust enrichment, breach of warranty, and violation of the Oklahoma Consumer Protection Act as noted in the report.
