A Mansfield man has lost his appeal regarding injuries sustained from a warehouse accident.
Mansfield (WiredPRNews.com) – An appeals court has upheld the decision of a lower court that a Mansfield man’s negligence contributed to injuries he sustained in a warehouse accident. As reported by MansfieldNewsJournal.com, the Fifth District Court of Appeals agreed that injuries sustained by Clark Jefferson after falling from a lift in 2005 was caused by the man’s failure to follow proper company procedures.
As noted in the report, Jefferson filed a lawsuit against Benjamin Steel Co. approximately two years after the accident seeking damages for medical expenses, pain and suffering, and lost wages. The courts reportedly found no evidence proving Benjamin Steel Co. was liable, citing the attorneys of the plaintiff failed to adequately show the company required their client to use the lift without going by the proper procedure.
